Rochester, MN (KROC-AM News) - A Rochester man accused of breaking into an ex-girlfriend's residence and assaulting her and their baby has been convicted of two of the three felony charges he faced.

An Olmsted County jury returned the split verdict in the case of 52-year-old Jermaine Johnson Sr. He was found guilty of two counts of first-degree burglary, but he was acquitted of third-degree assault involving a child. The jury also found him not guilty of a gross misdemeanor count of interfering with a 911 call but convicted Johnson of two misdemeanor domestic assault charges and a misdemeanor theft charge.

Johnson was arrested in August of last year after Rochester Police responded to a report of a domestic assault and spoke with a woman who told officers that he had choked her and struck their one-year-old son. She indicated Johnson had entered her apartment after the two argued over a text message.

He was also accused of taking her phone when she attempted to call 911. The criminal complaint alleged that Johnson then left the woman's residence with the phone. He was later pulled over by police and, according to the court document, admitted going to her residence and taking her phone. He denied that anything physical had happened.

The judge in the case has ordered a presentence investigation. Johnson's sentence has yet to be scheduled. He is currently being held in the Olmsted County Jail without bail.
