Rochester, MN (KROC AM News) - A Rochester woman has been charged with wiping out her daughter’s trust account and using the money for personal expenses.

A felony charge of financial exploitation has been filed against 66-year-old Pamela Fischer.

She has been ordered to make her first court appearance on May 27.

According to the criminal complaint, the Minnesota Adult Abuse Reporting Center reported the alleged abuse to the Olmsted County Sheriff's Office in January 2019.

Fischer was the legal guardian of her adult daughter, who is physically and mentally impaired and unable to care for herself without assistance. She was a resident of Bear Creek Services and an investigator learned she had an outstanding balance of $6,000 in unpaid bills.

At the time, Fischer was receiving her daughter’s Social Security funds and was responsible for her personal finances. The investigator discovered numerous transactions in the daughter’s bank account from November 2016 through December 2018 that were not for her benefit. The 96 transactions totaled $25,000. The transactions included 15 checks paid directly to Fischer and numerous ATM withdrawals.

The investigator also learned a special needs trust had been opened in the daughter's name after the passing of her father.

According to the complaint, “The trust was opened in August 2013 with a balance of $34,920.” When the investigator checked, it was discovered “the trust's balance had been depleted to a value of $18.11.”

The complaint says Fischer admitted using her daughter’s money "for her own benefit.”
