He reported to the police that he noticed one of his workers at the drive-through window gave a customer a free soda. When he asked his employee why, she said she had given the man pop because there was a gun in his lap and an alcoholic beverage in the console while he completed his food order, according to court records.

“She was trying to ‘get him out of there by giving him whatever he wanted.'"

The customer with the gun left the drive-through driving a silver Chevrolet Impala.

Washtenaw County officials issued a “be on the lookout” for the Impala at 11:02 p.m. on December 14th.

Spotting The Car

Thirty minutes later, two deputies spotted the Impala while patrolling in Superior Township. They pulled over the car inside an apartment complex in the 8800 block of Macarthur Boulevard.

Deputies explained to Nailor that his car had been pulled over because of a recent complaint at Taco Bell, then they asked Nailor if he had a gun.

Nailor denied having a gun. Police asked him to step out of the vehicle and he refused by saying “I can’t do that,” and, “no."

The woman in the front seat began yelling and arguing with the deputies. At that time police asked both the man and woman to provide their IDs. They refused.

Police continued to ask Nailor to step out of the car for 4 more minutes, to which he kept refusing and arguing. After 4 minutes backup deputies arrived at the scene.

Finding A Weapon

One of the deputies spoke with the woman in the passenger seat and saw her stuff something into her pants. She claimed she was grabbing her "weed."

After being asked multiple times to step out of the vehicle, she finally complied. As another deputy walked up to the car with a flashlight he spotted a gun under the passenger seat. The deputy yelled, "gun," and Nailor was forcefully removed from the driver's seat according to court records.

Nailor tried to resist arrest while being placed in handcuffs. He stiffened his body, kept arguing, and did not wilfully allow officers to put him in custody.

Since the gun was found in an "open and accessible location," the woman was also placed into handcuffs.

The woman said she was "confused and didn’t understand why the Taco Bell would call about them and that there was no altercation, and the employee even gave them a ‘free pop,’” the criminal complaint says.

She confirmed they had just been at Taco Bell and that nobody else had been in the car.

Searching The Car

After Nailor was put in the back of the squad car he refused to cooperate when asked about the gun found in the car.

The handgun was found on the floorboard along with a large amount of marijuana in the console area and a Taco Bell bag.

After a special agent investigated the gun, it was determined to be a Sig Sauer P229 pistol that had been stolen on December 18, 2021, in Detroit. The special agent said the gun was loaded with 12 rounds of 9 mm ammunition.
