Rochester Man Wants Murder Case Records Sealed

Rochester, MN (KROC AM News) –  Two mistrials and a dismissal – and now an expungement request.

The attorney for a Rochester man who was tried twice for killing a teenager has filed a petition with the court to expunge his record.

A March 24th hearing has been scheduled to hear the request filed by attorney James McGeeney. He represented Alexander Weiss in his 2nd-degree murder case. Weiss was charged in the Jan. 2018 shooting death of 17-year-old Muhammed Rahim. The point-blank shooting occurred during a confrontation that followed a minor traffic incident.

The 27-year-old Weiss went to trial twice and both juries deadlocked. Olmsted County Attorney Mark Ostrem decided in November not to go to trial a third time and dismissed the case.

McGeeney’s request will be heard by Judge Joseph Chase, who presided over both trials. McGeeney says Weiss is seeking the expungement so the court file and all related records – including his mugshot and fingerprints – are sealed from the public.
